‘Literally Raining Crap:’ Long Grove Family Sues Insurance Company, Claiming They Got Runaround About Repair Coverage After Sewage Rained Down In Their Home

LONG GROVE, Ill. (CBS) – What started as a plumbing nightmare turned into an insurance nightmare – and now

They told Tim McNicholas of CBS 2 all about the smelly situation.

The clays thought they had moved into their dream home.

“I thought it was great,” said LaShawn Clay. “It was big enough for my family and me.”

But they say the seller never mentioned the septic problem that would rain on their parade a few months later.

“It’s literally raining crap,” said Clay.

They woke up in the middle of the night to find the toilets and showers merged into vents that led directly into the basement. So her home and personal effects were hit with a lot of you-know-what.

“One of the areas that was exposed was in the laundry room,” said Clay. “It was literally crap in the washing machine.”

Clay added, “And it’s not even our crap because we just moved here.”

That was March 2020, but the repairs are still ongoing. The family accuses a dispute with the state auto insurance company.

“I hate using the word, but it bubbled,” said Clay.

The clays showed us a document from State Auto that estimated the cash value of repairs and parts to be nearly $ 126,000. But the family said State Auto only paid about $ 90,000, and even that was a struggle.

“The only reason I got the money was because I found a lawyer because nobody would speak to us,” said Clay.

With the same attorney, they are suing State Auto, accusing it of breaking their contract by failing to cover about $ 20,000 in damaged personal belongings.

“It was in the closets. It was in the oven, ”said Clay. “It was everywhere.”

The Clays say they also got the bypass from the company when they tried to get coverage of temporary housing, so they had to live, work, and e-learning from home – where you can still get here and there can feel a touch of this hustle and bustle March morning.

“It was everywhere,” said Clay.

In their response to the lawsuit, State Auto is pressing against many of Clay’s claims, but they say the family did not provide enough documentation for the personal property claim.
